Williams Digital Services Network "Terms of Use"

By accessing and using any Williams Digital Serivces™ domain or web site (hereinafter “we”, “us”, “our”, “WilliamsDigital.Net™ ”, “WilliamsDigital.Com™ ”, “WilliamsDigital.Us™ ”, “Williams Digital Services™ ”, “wdsBB™”, “wdsGallery™”, “wdsStore™”), you agree to be legally bound by the following terms. If you do not agree to be legally bound by all of the following terms then please do not access and/or use any of the Williams Digital Services web sites. We may change these terms at any time and we’ll do our utmost in informing you, though it would be prudent to review this regularly yourself as your continued usage means you agree to be legally bound by these terms as they are updated and/or amended. wdsBB™ is powered in part by phpBB which is an open source solution released under the “General Public License” (hereinafter “GPL”). You agree to indemnify, defend and hold harmless Williams Digital Services™, wdsBB™, phpBB, WilliamsDigital.Net™, WilliamsDigital.com™, WilliamsDigital.Us™ and its officers, directors, employees, agents, licensors, suppliers and any third party information providers to the service from and against all losses, expenses, damages and costs, including reasonable attorneys´ fees, resulting from any violation of this Agreement (including negligent or wrongful conduct) by you or any other person accessing the Service. However, inappropriate posts will be removed as quickly as possible by the wdsBB™ administration and the offending user will be held 100 percent liable for any and all damages that may result.

You agree not to post any SPAM, abusive, obscene, vulgar, slanderous, hateful, threatening, sexually-orientated or any other material that may violate any laws be it of your country, the country where wdsBB™ is hosted or International Law. Doing so may lead to you being immediately and permanently banned, with notification of your Internet Service Provider if deemed required by us. The IP address of all posts are recorded to aid in enforcing these conditions. You agree that WilliamsDigital.com™, wdsBB™ Administrators and appointed agents such as Group Moderators will have the right to remove, edit, move or close any topic at any time. As a user you agree to any information you have entered to being stored in a database. While this information will not be disclosed to any third party without your consent, neither WilliamsDigital.com™ nor phpBB shall be held responsible for any hacking attempt that may lead to the data being compromised.

Although Williams Digital Services™ attempts to provide files available for downloading to be free of infection or viruses, worms, Trojan horses or other code that manifest contaminating or destructive properties, you understand that Williams Digital Services™ cannot and does not guarantee or warrant that files available for download will be free of infection or viruses, worms, Trojan horses or other code that manifest contaminating or destructive properties. You are responsible for implementing sufficient procedures and checkpoints to satisfy your particular requirements for accuracy of data input and output, and for maintaining a means external to Williams Digital Services™ for the reconstruction of any lost data.

Except where otherwise provided, access to and the use of the wdsStore™, wdsGallery™ and wdsBB™ are currently available to the public without charge. Williams Digital Services™ and all of it's constituants reserve the right to charge a fee for access to or the use of this or any Williams Digital Services™ domain component(s) at any time in the future. Your access to or use before such time does not entitle you to use without charge in the future.

This Agreement shall all be governed and construed in accordance with the laws of The United States of America applicable to agreements made and to be performed in The United States of America. You agree that any legal action or proceeding between Williams Digital Services™ or any of it's components and you, for any purpose concerning this Agreement or the parties´ obligations hereunder shall be brought exclusively in a federal or state court of competent jurisdiction sitting in The United States of America and in South Western Idaho.
Any cause of action or claim you may have with respect to Williams Digital Services™ must be commenced within one (1) month after the claim or cause of action arises or such claim or cause of action is barred. Williams Digital Services™ or it´s component´s failure to insist upon or enforce strict performance of any provision of this Agreement shall not be construed as a waiver of any provision or right. Neither the course of conduct between the parties nor trade practice shall act to modify any provision of this Agreement. Williams Digital Services™ may assign its rights and duties under this Agreement to any party at any time without notice to you. Any rights not expressly granted herein are reserved.
